历史场景中的法律与社会研究何以进行?——《聚讼纷纭:清代的“健讼之风”话语及其表达性现实》评介

摘　　要：关于“无讼”与“健讼”的学术公案旷日持久,成果颇丰。这一关系到中国传统社会中的法律实践和诉讼文化的命题,引发了多领域、多视角的讨论。当前,《聚讼纷纭:清代的“健讼之风”话语及其表达性现实》一书以承继“瞿同祖范式”的学术雄心,吸收多种核心概念,围绕“健讼之风”的话语性本质,爬梳历史田野,切换多重视角,致力于在历史场景中展开法律与社会碰撞及影响的研究。从结构、材料、视角、理论四个角度出发对该著作的周延性、完成度与开拓性进行讨论后可知,该书较好地完成了作者设定的论证目标。其结构能够支撑起相应内容,而两者结合则服务于“表达性现实”与“客观性现实”的张力型二元论说,因而展示了“健讼之风”话语在复杂的社会角力之中建构与运作的机制,为“新法律史”或法律社会学研究者提供了方法论和研究命题等方面的启发。In regard to“No Litigation”and“Litigation Preference”,there is apersistent and fruiful debate of scholars.The discussion involves multi-fields and multi-perspectives because of the relationship with legal practice and ltigation culture in traditional Chinese society.Today,Litigation Culture in Controversy:the Discourse of“Litigious Atmosphere”and Its Representational Reality in Qing China shows the academic ambition of inheriting“Paradigm of Qu Tongzu”and it absorbs various core concepts.Focusing on the essence of“Litigious Atmosphere”as the discourse,the monograph analyzes files from historic fields and chooses different perspectives for managing to conduct the research of law and society in the historical scenes.After reviewing and discussing the logic,achievement and innovation of it from aspects of the structure,materials,perspectives and theories,it is concluded that the monograph achieve the goal of argument set by the author.The structure can support the content and both of them effectively service the dualistic and adversarial argument of“Expressive Reality”and“Objective Reality”,so.the monograph reveals the mechanism how the“Litigious Atmosphere”discourse forms and operates in the complex wrestle of society.It also provides the researchers of“New Legal History”or legal sociology with the ideas of methodologies and research propositions.
