网络犯罪证明中的综合认定方法

摘　　要：综合认定是一种常见的事实认定方法,当前作为一种简化证明方法被应用到网络犯罪案件中犯罪数额、主观方面的证明中。综合认定并未突破印证证明的基本要求,综合认定中的印证证明主要表现为证据对事实的整体印证,综合认定依据的主要是经验法则和日常逻辑。但在司法实践中综合认定的适用也出现了一些风险,如将综合认定等同于证明标准的降低,庭审程序的虚化、证明责任向辩方的不当转移以及推定适用的扩张等也给综合认定带来诸多正当程序风险。为确保综合认定方法被恰当适用,应该厘清印证证明与证明标准间的关系、适当放宽被严格限制的证据方法并建立开放性和争辩性的庭审程序。Comprehensive identification is a common method of ascertaining facts,which is used in the proof of the criminal amount and subjectivity in cybercrimes.The mechanism of comprehensive identification should satisfy the requirements of verification.The verification in comprehensive identification is a kind of whole verification between the evidence and the facts,and the base of comprehensive identification is the rule of thumb,common sense and logic.However,there are some legal risks when judges apply the comprehensive identification to ascertain facts,such as the reduction of proof standard,the risk of due process from the virtualization of court proceedings,the improper transfer of the burden of proof and the extensive application of presumption.Therefore,the relationship between the verification and proof standard should be readjusted,the strictly restricted evidence kinds should be appropriately relaxed,and the procedure of comprehensive identification should be rebuilt.
