《突发事件应对管理法(草案)》的问题与建议——基于三重视角的分析

摘　　要：《突发事件应对管理法(草案)》基本适应我国突发事件应对工作的实际情况,有助于提高我国突发事件应对工作的法治化、科学化、规范化水平。但是,仍存在进一步完善的空间。应当引入行政应急性原则,在授权立法下,引入快速立法程序;完善、激活事后审查机制;明确设定合法行使行政应急权的底线。应当贯彻协调性原则,既要关注法条内部的协调关系,又要关注本法与其他法律之间的协调关系。应当落实效能原则,赋予各级应急管理部门监督管理、检查评估职责。建议立法机关遵循上述原则,进一步修改相关法条。The“Emergency Response and Management Law(Draft)”basically adapts to the actual situation of our country’s emergency response,and helps to improve the legal,scientific and standardized level of our country’s emergency response.However,there is still room for further improvement.The principle of administrative emergency should be introduced,and the rapid legislative procedures should be introduced under authorized legislation;the post-event review mechanism should be improved and activated;and the bottom line for legally exercising the power of administrative emergency should be clearly set.The principle of coordination should be implemented,paying attention not only to the coordination relationship within provisions of the law,but also to the coordination relationship between this law and other laws.The principle of efficiency should be implemented,giving all levels of emergency management departments the responsibilities of supervision,management,inspection and evaluation.It is suggested that the legislative organ shall follow the above principles and make further amendments to relevant laws.
