检察机关侦查权的部分保留及其规范运行——以国家监察体制改革与《刑事诉讼法》修改为背景

摘　　要：国家监察体制改革得到宪法、法律层面的肯认之后,需要《刑事诉讼法》修改调整检察机关的侦查职权,进而解决监察制度与刑事诉讼制度的衔接问题。2018年修改后的《刑事诉讼法》中保留的检察机关侦查权,其监督性得到显著强化,巩固了检察机关法律监督机关的宪法地位。当前需要从检察机关侦查权与监察机关调查权的协调、检察机关内部的分工与合作、检察机关侦查能力的培养与强化等方面着手,确保检察机关侦查权形成长效的规范运行机制。After the reform of the National Supervision System is approved by the Constitution and the law,the Criminal Procedure Law needs to modify and adjust the investigation power of the procuratorial organ,so as to solve the connection problem between the supervision system and the criminal procedure system. The procuratorial organ’s investigation power retained in the revised Criminal Procedure Law in 2018 has been significantly strengthened in its supervision,consolidating the constitutional status of the procuratorial organ’s legal supervision. At present,it is necessary to coordinate the investigation power of procuratorial organ with that of supervision organ,to divide and cooperate within procuratorial organ,to cultivate and strengthen the investigation ability of procuratorial organ,so as to ensure the long-term standardized operation mechanism of the investigation power of procuratorial organ.
