摘　　要：航运业是全球经济高速发展的重要支撑和保障,航运业的繁荣得益于船员的巨大付出,他们在海上作业的危险是无法想象的,船员应当得到尊重和善待,但是船员遗弃事件却频频发生。船员被遗弃后基本生活得不到保障,无法获得及时遣返,这严重侵害了船员的合法权益,船员的遣返问题受到国际组织与社会的关注,如何保障被遗弃船员的遣返权已经成为航运业面临的重大问题之一。我国国籍船员在域外被遗弃的人数逐年上升,这说明我国在船员遣返权保障方面存在一些问题,为了保障我国船员的合法权益及维护航运业秩序,本研究在概述被遗弃船员的遣返权及其特点的基础上,研究被遗弃船员的遣返权现状、存在的问题及成因,总结域外被遗弃船员的遣返权保障经验,针对我国相关方面的不足与缺陷提出建立专门救助平台、完善财务担保制度、完善法律条款与加强国际合作等对策建议。The shipping industry is an important support and guarantee for the rapid development of the global economy.The prosperity of the shipping industry benefits from the huge contributions of the seafarers.The danger of their operations at sea is unimaginable.Seafarers should be respected and treated well.However,incidents of seafarer abandonment occurred frequently.The basic life of the seafarer is not guaranteed after being abandoned,and they cannot be repatriated in time.This seriously violates the legitimate rights and interests of the seafarers.The problem of seafarer repatriation has attracted great attention from international organizations and society.How to protect the repatriation rights of abandoned seafarers has become one of the major problems facing the shipping industry.The number of Chinese seafarers who have been abandoned outside the territory has been increasing year by year.This shows that there are many problems in the protection of seafarer repatriation rights in our country.In order to protect the legitimate rights and interests of Chinese seafarers and maintain the order of the shipping industry,the article outlines the repatriation rights and characteristics of abandoned seafarers.On the basis of summarize the status quo,this paper describe the existing problems and causes of the repatriation rights of abandoned seafarers,analizes the experience of protecting the repatriation rights of abandoned seafarers outside the territory.In view of the shortcomings of repatriation right in China,this paper proposed the following suggestions:establish a special rescue platform,improve the related financial guarantee system and legal provisions,strengthen international cooperation to protect the legitimate rights and interests of abandoned seafarers et al.
