我国海洋环境监测法律制度的可持续发展思考

摘　　要：中国既是一个陆地大国,也是一个海洋大国,随着科技的迅速发展,陆地资源不断被开采,海洋资源也亟待开发利用,近年来国家将目光转向物产丰富的浩瀚海洋。各国海洋开发经验证明,伴随人类海上活动不断增加和开发规模日益扩大,发展过程中产生一系列的资源和环境问题,严重地影响了海洋资源以及经济的可持续发展。正所谓“,财富取之于海上,危险亦来自于海上”。海洋环境监测在海洋环境保护中发挥了重要的作用。但是,依据目前国家有关环境监测制度看,还存在一些不足,需要通过法律制度加以规范以至其能满足可持续发展的要求。因此,建议严格遵循可持续发展原则,建设海洋环境监测法律体系;完善海洋专业人才培养政策,构建合理的海洋环境监测队伍;借鉴海洋法完备的国家立法经验,逐步完善海洋环境监测法律体系;推动海洋科技的可持续发展,建立与科技相互支撑的海洋法律法规;完善海洋环境监测数据资源,加大海洋信息资源的现代化建设。Marine environmental monitoring plays a vital role in the development of China’s marine undertakings and directly affects the sustainable development of marine resources and marine economy.In the face of increasing maritime activities and expanding scale of development,we must attach importance to marine protection,rationally develop and utilize marine resources and promote marine ecological progress.As a maritime power,China has gradually promoted the work of marine environmental monitoring and made new progress.However,according to the current situation of China’s marine environment,compared with the effective experience of foreign major countries on the legal system of marine environment monitoring,China’s current legal system of marine environment monitoring still has some deficiencies.It is necessary to further improve the legal system of marine environmental monitoring in China,clarify the norms and standards of marine environmental monitoring,realize the legal construction of relevant systems,and establish a legal monitoring team with both talents,so as to conform to the concept of sustainable development in China and ensure the long-term development of marine environment,resources and economy.
