摘　　要：土地储备制度与自然资源产权改革密切相关。对既往土地储备制度法律问题研究进行梳理,既是对原制度的承继与深化,亦是对改革框架下准确定位土地储备制度研究起点的逻辑依循。遵循法律制度主体、客体、运行过程研究视角,发现既有研究对土地储备制度中法律主体不明晰、法权基础呈土地国家所有权与监管权混合样态、土地收储实践公益目标偏离等问题进行了充分剖析,但仍存在完善建议与实践脱节、研究成果碎片化、研究结果时效性不强等未竟之处。特别是既有研究难与生态文明体制改革衔接,对土地储备制度落实所有者权益、促进土地资产保值增值等法学研究视角缺位。故未来对土地储备制度的研究须对原制度功能进行扩充,通过重新厘定制度的概念和功能定位,明晰土地储备制度主体法律地位,优化所有者职责主体的行权模式,建立并完善配套制度安排。The land reserve system is closely related to the property right reform of natural resources.Sorting out the previous research on the.legal issues of the land reserve system is not only a continuation and deepening of the original system,but also a logical follow to accurately locate the starting point of the land reserve system research under the framework of reform.Following the research perspective of the subject,objeet and operation process of the legal system,it is found that the existing researches have fully analyzed the problems in the land reserve system,such as the unclear legal subjct,the mixed state ownership of land and the right of supervision,and the deviation of the public welfare goal of land acquisition and storage practice.However,there are still some unsolved problems,such as disconnection between improvement suggestions and practice,fragmentation of research results and weak timeliness of research results.In particular,the existing research is difficult to connect with the ecological civilization system reform,and the legal research perspective of land reserve system implementation of owners’rights and interests,to promote the preservation and appreciation of land assets is lacking.Therefore,the future research on the land reserve sy stem should expand the function of the original system,clarify the legal status of the main body of the land reserve system,optimize the exercise mode of the owner's responsibility subject,and establish and perfect the supporting system arrangement by redefining the concept and functional positioning of the system.
