摘　　要：现行空间规划立法的结构和功能都存在体系性问题,主要表现在立法的考量整体性、逻辑自洽性、形式一致性、结构层次性、价值融贯性等五个方面的缺失,亟待通过体系化方法予以解决。国土空间规划立法的体系化包括结构的体系化和功能的体系化。结构的体系化是指通过立、改、废、释等方式,构建全面、完整的国土空间规划立法框架,确定《中华人民共和国国土空间规划法》的基本法地位是达成这一目标的最佳选择。功能的体系化是指将各项规划法律功能配置给相应的法律法规,既注重国土空间规划法律法规内部之间的合理配置,也注重与外部相关法律法规之间的衔接协调。由此实现国土空间规划法律体系的有机统一。There are systemic problems in the structure and function of the current spatial planning legislation,which are mainly reflected in the lack of five aspects:the overall consideration of legislation,the self-consistency of logic,the consistency of form,the level of structure,and the coherence of value.It needs to be solved urgently through a systematic approach.The systematization of territorialspatial planning legislation includes the systematization of structure and the systematization of function.The systematization of the structure refers to building a comprehensive and complete legislative framework for territorialspatial planning through establishment,reform,abolition,and interpretation,etc.,and determining the basic law status of the TerritorialSpatial Planning Law is the best choice to achieve this goal.The systematization of functions refers to the allocation of various legal functionsof territorial spatialplanningto the corresponding laws and regulations,which not only pays attention to the rational allocation of the internal laws and regulations of territorial spatial planning,but also pays attention to the connection and coordination with relevant external laws and regulations.In this way,the organic unity of the legal system of territorial spatialplanning is realized.
