摘 要:检视《土地管理法(修正案)》(第三次征求意见稿),虽然不乏亮点,但是对于十八届三中全会后,开启的新一轮土地制度改革实践的回应相对谨慎保守,在土地管制规划与国土空间规划的协同、集体经营性建设用地入市、宅基地管理制度改革、土地征收范围和程序等诸多层面还存在问题。引致作为公权的土地管理权与私权属性的土地财产权冲突抵牾,公私法益偏移失衡,滞碍了供给侧结构性改革推进和土地制度改革实践发展,亟待完善。Although there are many highlights,the third version of Draft Land Administration Law(Amendment)takes a relatively prudent and conservative attitude on the reform of land system practices launched after the Third Plenary Session of the 18 th CPC Central Committee.Several fundamental systems remain ambiguous,such as the coordination between General Plan of Land and Territory Spatial Plan,entry of Rural Collectively-Owned Commercial Construction Land into the Market,the reform of Housing Land Management and the scope and procedures of Rural Land Acquisition,which triggers the conflict between public administrative power of land and private property rights of land and imbalance the relationship between public and private interests.In addition,such problems pose an obstacle on the supply-side structural reform and the reform practice of land system.Therefore,Draft Land Administration Law(Amendment)needs to be revised urgently.
