摘 要:在简政放权、"放管服"的政府职能转变改革的潮流中,环境影响评价制度也迎来重大变动:环评审查由"串联"改为"并联";环评监管重心从事先审查转向事中、事后审查;环评机构与生态环境部门脱钩。这一波环评制度改革虽然会加快审批流程,提升行政效率,但其效果是淡化事先审查,从而导致环评功能的衰弱。为了纠正这一偏颇,可以干脆将环评审批权与项目审批权合二为一。这既是回归环评制度设计的最初目的——环境理性的"内在化",也符合我国相对集中行政审批改革的趋势,为我国环境治理现代化事业踵事增华。In the trend of reform of government functions of simplification and decentralization,the environmental impact assessment system has also undergone major changes:EIA review changed from"series"to"parallel";the focus of EIA supervision shifted from prior review process to in-process and post review;the EIA agency is decoupled from the ecological environment department.Although this wave of EIA reform will speed up the approval process and improve administrative efficiency,its effect is to dilute the pre-examination,resulting in the weakening of the EIA function.In order to correct this bias,we can simply combine the EIA approval power with the project approval power.This is not only the original purpose of returning to the EIA system design—the"internalization"of environmental rationality,but also in line with the trend of relatively centralized administrative examination and approval reforms,and it has added to my country’s environmental governance modernization cause.
