摘  要:据有关调查数据显示,目前,新就业形态劳动者在全国职工总数中已有相当大的占比,成为一个新兴群体,算法则是新业态劳动管理的关键技术。完善新业态劳动管理算法法律规制,保护劳动者合法权益,促进平台经济有序发展,是深入贯彻习近平总书记关于新就业形态劳动者权益保护系列重要指示精神、深入贯彻党的二十大报告关于支持和规范发展新就业形态重大部署的重要举措。本文结合新业态劳动管理算法运行情况,着重探讨了新业态用工劳动关系认定和劳动权益保障、算法生效标准等问题,着力解决新业态劳动管理算法规制难点,为新就业形态健康发展作出有益探索。According to survey data,currently,workers in the new employment form take a considerable proportion in the total number of employees in the country,becoming an emerging group,and algorithms are the key technology for labor management in the new employment form.Perfecting the legal regulation of labor management algorithms in new employment forms,protecting the legitimate rights and interests of workers,and promoting the orderly development of the platform economy are important measures for the thorough implementation of General Secretary Xi Jinping's series of important instructions on protecting the rights and interests of workers in new forms of employment,and for the thorough implementation of the major deployments about supporting and standardizing the development of new forms of employment as stated in the report of the 20th CPC National Congress.This article,in conjunction with the operation of labor management algorithms in new employment forms,focuses on discussing issues such as the determination of labor relations and the protection of labor rights and interests in new employment forms,and the effective standards of algorithms,striving to solve the difficulties in regulating labor management algorithms in new employment forms,and making beneficial explorations for the healthy development of new forms of employment.
