党内法规备案审查衔接联动机制的规范阐释与制度优化

摘　　要：党内法规备案审查衔接联动机制是党内法规备案审查制度的组成部分,是提升党内法规的质量与合法性,推进法治中国建设的重要制度安排。党内法规备案审查衔接联动机制通过整合党和国家备案审查机关及其治理体制,从而塑造了中共中央办公厅的职权型合法性审查与全国人大常委会法工委、司法部的授权型合法性审查互动关联的党内法规“双轨制审查”组织结构和差序性权力关系。党内法规备案审查衔接联动机制通过整合分工负责、移送处理、征求意见、审查监督、沟通协调、会商研究、信息共享等程序性安排,实现了党内监督和国家法制监督的制度衔接与组织联动。党政分工与组织协同的组织逻辑、政治与法治平衡互动的价值逻辑、多元化治理的治理逻辑共同提供了党内法规备案审查衔接联动机制规范建构的理论依据。在现阶段,应当从强化审查监督的实效性、提升机制治理的全面性、增强机制运转的保障性等方面持续优化党内法规备案审查衔接联动机制,最大限度激活机制的法治效能。The linkage mechanism for the filing and review of party regulations is an integral part of the filing and review system of party regulations,and it is an important institutional arrangement to improve the quality and legitimacy of party regulations and promote the construction of China under the rule of law.The linkage mechanism for the filing and review of party regulations has shaped the legitimacy review of the General Office of the CPC Central Committee by integrating the filing and review organs of the Party and the state and their governance system,which is interactively related to the legitimacy review authorized by the Legislative Affairs Commission of the Standing Committee of the National People’s Congress(NPC)and the Ministry of Justice,and forms the governance structure and differential power relationship of the"two-track review of party regulations.Through procedural arrangements such as integration of division of labour with individual responsibility,transfer and handling,soliciting opinions,examination and supervision,communication and coordination,consultation and research,and information sharing,the linkage mechanism for the filing and review of party regulations has realized the system connection and organizational linkage of inner-party supervision and national legal supervision.The organizational logic of the division of labor between the party and the government and the coordination of the organization,the value logic of the balance and interaction between politics and the rule of law,and the governance logic of diversified governance provide the theoretical basis for the normative construction of the linkage mechanism for the filing and review of party regulations.At the present stage,we should continuously optimize the linkage mechanism for the filing and review of party regulations by strengthening the effectiveness of examination and supervision,enhancing the comprehensiveness of mechanism governance,and strengthening the guarantee of mechanism operation,so as to maximize the effective
