摘　　要：线上调解一直以来都面临“效能论”与“机能论”之间的争论。从媒介传播的视角看,线上媒介技术的存在会对人际沟通过程产生质的影响,在线上媒介中,非语言行为会遭受损失。非语言信息的缺失将对调解员、调解的互动过程,以及调解的解纷效果产生不利影响。具体而言,线上的沟通环境导致调解员耐心的消耗与注意力的下降,互动氛围友善程度的降低,以及通过识别情绪发现当事人真实需求的困难。调解解纷机制有效展开所依赖的深度沟通要求与线上“贫媒体”的扁平化结构之间存在着机能失调。正是这种机能失调构成了法院在线调解发展现状不够令人满意的深层原因。因此,法院不应单纯追求解纷过程的“线上化”,而是应该尝试建构线上、线下调解案件分流的类型学框架,突出智能系统在案件管理维度的功用与价值,以更加开放的态度迎接科技对司法过程的深度赋能,如此,方能在机能维度有效地提升线上调解的运行质量。Online mediation has always been confronted with a debate between“efficiency theory”and“function theory”.From the perspective of media communication,the technological existence of online media will have essential impact on interpersonal communication,and non-verbal behaviors will suffer losses in online media.The absence of non-verbal information will have a significant negative impact on the mediator,the interaction process of mediation and the effect of mediation.To be specific,the online communication environment will lead to the decline of mediator’s attention and judgment,the damage of the friendly interactive atmosphere and the difficulty in discovering the real needs of the parties through the identification of emotions.In general,there is an internal functional tension between the deep interpersonal communication requirement in the mediation mechanism and the flat structure of“poor media”in the online context.It is this functional tension that constitutes the unsatisfactory development of court’s online mediation.Therefore,the court should not simply pursue the“online”process of dispute resolution,but construct a typological framework of dispute distribution online and offline,highlight the function and value of intelligent system in the dimension of case management,and be equipped with a more open mind to the deep empowerment of science and technology in the judicial process.In this way,the operation quality of online mediation can be effectively improved in the functional dimension.
