摘　　要：“本法另有规定的,依照规定”对普通罪名的除斥适用具有前置条件,行为需双重符合普通罪名与特别罪名。衡量该符合性的标准是,行为至少应符合特别罪名的罪质,否则无从产生除斥普通罪名适用的效果。罪质的符合是构成要件轮廓与实行行为类型的满足,而不能仅是构成要件的形式符合或外观相似。而且,对罪质的判断必须坚持从大前提到小前提的涵摄次序,不可混淆罪质的形式判断与实质判断,进而单向适用特别罪名,否则会造成刑法评价的不当失衡。If there are other stipulations in this Law,those stipulations shall apply.There are prerequisites for the exclusion and application of ordinary charges,and the behavior must be dual compliance with ordinary charges and special charges.Regarding the grasp of conformity,the behavior should at least meet the quality of the special charge,otherwise it will not have the effect of excluding the application of ordinary charges.The conformity of the quality of a crime is the satisfaction of the outline of the constituent elements and the type of conduct carried out.It cannot be based on the form or appearance of the constituent elements,and the judgment of the quality of a crime must adhere to the order of inclusion from the main premise to the minor premise.It cannot be confused through the judgment of the quality of a crime,and then apply special charges unilaterally,resulting in an imbalance in the evaluation of criminal law.
