摘　　要：本文主要希望借助"3Q大战"案件回到网络法的元问题:谁创设、控制赛博空间,赛博空间如何扩展,进而反映了何种生产关系、要求何种法律关系。本文也试图借助空间这一概念,沟通中外研究脉络,尝试提炼(特别是中国)互联网演进以及网络法变迁的理论框架。这一框架希望展示数字封建经济体形成的过程,特别是平台企业如何通过技术变迁和商业模式最大限度地从事赛博空间的生产和再生产,在智能终端挤压私人隐私和公共领域;同时,又和其他竞争对手展开争夺,最终塑造赛博空间。在面对商业力量不断扩张的时候,我们有必要反思如何确保一个合理平衡的赛博空间秩序,重新审视数字社会的权力结构和社会关系,关注商业力量以外兴起的社会组织和社会生态,围绕诸如账户和基础身份认证这样的"制度—技术"机制展开,在机理上重建空间观念,探讨赛博空间中真正的主体性及其法律和技术支撑。This article mainly aims to use the"3Q War"case to return to the meta-question of cyber law:who creates and controls cyberspace,how cyberspace expands,and what kind of production relations it reflects and what kind of legal relations it requires.This article also attempts to use the concept of space to bridge the research lines between China and the West and to extract a theoretical framework of the evolution of the Internet and the transformation in cyber law(especially in China).This framework hopes to show the process of the formation of digital feudal economies,in particular how platform companies maximize the production and reproduction of cyberspace through technological changes and business models,squeezing private privacy and the public sphere at smart terminals;while at the same time competing with other competitors to ultimately shape cyberspace.In the face of expanding commercial power,it is necessary to rethink how to ensure a reasonably balanced cyberspace order,to re-examine power structures and social relations in digital society,and to focus on the emerging social organization and social ecology apart from commercial power,revolving around"system-technology"mechanisms such as accounts and basic identity authentication,reconstructing the notion of space mechanistically and exploring real subjectivity in Cyberspace and its legal and technical support.
