执法能力视野下公安执法主体与社会互动样态的观察与反思

摘　　要：公安执法能力关乎执法主体与社会的磨合,反映的是国家对社会的形塑状况,因此需要考察国家与社会的互动关系。当下涉警舆情案件反映出互动主体抗争性显著,互动内容公开性增强以及互动方式复合化突出等特点。总体上,冲突较为频繁,协商渐成日常。造成此种困境之原因,既与执法主体能力不足有关,也受制于部分社会主体法治意识不强与传媒报道的功利性等社会层面因素的影响。未来,为促进公安执法主体与社会的良性互动,从公安执法主体角度,应进一步提升执法能力,即优化执法方式与健全执法公开机制;就社会层面而言,应走向法治轨道,即增强法律意识与规范公安执法活动的新闻报道。The law enforcement ability of the public security organs is related to the running-in between the law enforcement subjects and the society,and reflects the shape of the state to the society.Therefore,it is necessary to investigate the interaction between the state and the society.At present,the current public opinion cases involving the police reflect the strong tug of war of interactive subjects,the enhanced openness of interactive content and the prominent combination of interactive methods.On the whole,conflicts are relatively frequent,and consultation has gradually become normal.The reason for this dilemma is not only related to the lack of ability of law enforcement subjects,but also influenced by social factors such as the weak legal consciousness of some social subjects and the utility of media reports.In the future,in order to promote the benign interaction between the public security law enforcement subjects and the society,from the perspective of the public security law enforcement subject,we should further improve law enforcement capabilities,that is,we should focus on improving law enforcement methods,and improving the mechanism for publicizing law enforcement;As far as the social level is concerned,we should move on the track of the rule of law,that is to enhance the legal awareness and standardize the media reports on public security law enforcement.
