摘　　要：英国法律发展史是世界法治文明史上独具特色的重要组成部分,现代意义上的法治文明便发祥于此。英国刑法的形成与发展孕育于英国法律整体发展史之中,英国刑法历经习惯、习惯法、判例法到制定法,逐渐形成了判例法与制定法并存的局面。鉴于英国判例法源远流长及制定法后来居上的特点,一部统一刑法典的编撰现今仍显得较为遥远,这也使得英国刑法较大陆法系各国刑法显得有些支离破碎。但具有悠久历史以及特色鲜明的英国刑法,其理论、内容是成熟、完备的,也是务实、科学的。其坚守传统与注重实用的基本立场,凸显出功利性的色彩。这使得英国刑法在饱含自我特色的基础之上具备了解决日益复杂的现实问题的灵活性,满足其保护公共利益之所需,也为我国的法治建设与刑法发展提供了借鉴与参考。The history of the development of British law is an important part of the unique history of the rule of law in the world.The rule of law civilization in the modern sense has been born here.The formation and development of British criminal law was born in the history of the overall development of British law.It has experienced the development process from habit,customary law,case law to statute law.The British criminal law has gradually formed a situation in which case law and statute law coexist.In the United Kingdom,where the case law has a long history and statute law is later established,the goal of compiling a unified criminal code is still somewhat distant at present.This also makes the United Kingdom’s criminal law system somewhat fragmented.However,the British criminal law,which has a long history and distinctive characteristics,is mature and complete in theory and content,and is also pragmatic and scientific.Its adherence to the traditional and practical basic position highlights the utilitarian color.This makes the British criminal law have the flexibility to solve increasingly complex real problems on the basis of selfcharacteristics,and meet the needs of protecting the public interest.It also provides reference for the construction of the rule of law and the development of criminal law in China.
