摘 要:通过图表、分类和典型案例相结合的方法,逐案研读我国法院适用《中华人民共和国涉外民事关系法律适用法》第43条劳动合同法律适用规则的裁判文书,可以发现其中存在五个问题:涉外、涉港澳台因素判断不当,法律关系定性错误,错引法律原则和其他规定,错选连结点,最后裁判依据不当。最后,从正确判断涉外和涉港澳台因素、准确识别法律关系、准确援引《法律适用法》条文、正确选择连结点、规范最后裁判依据五方面提出改进建议。By using the method of combining chart,classification and typical cases,and based on a case-by-case study in judgements which apply the applicable rules of labor contract law in Article 43 of the Law of the People’s Republic of China on Foreign-related Civil Relations,we can find out five major problems,like improper judgment of foreign-related factors,wrong characterization of legal relations,misquoting of other provisions,errors in the selection of joint points and incomplete provisions in the final judgment.Finally,some suggestions for judicial improvement are put forward from five aspects:correctly judging foreign-related factors,accurately identifying legal relations,correctly quoting other provisions,accurately selecting the connecting points and standardizing the final judgment basis,so as to further standardize Chinese courts to applying the rules of labor contract law with ideas.
