摘 要:《关雎》一直以来都被定义为情歌,但其对婚恋关系的规范作用却与《侗款》之间存在着微妙的联系。以《侗款》解读《关雎》,可以发现《关雎》实际上是一首规范男女关系的“诗体法”。事实上,在先秦时期,《诗》在刑罚适用、婚姻家庭、外交政治、市场管理等方面都具有习惯法的规范功能。《关雎》中的三段诗句,如“君子好逑”“参差荇菜,左右流(采、芼)之”“琴瑟友之、钟鼓乐之”依次包涵着对男女婚恋关系“应当规范”“如何规范”“正当模式”的内容,而这些都和《侗款》中关于男女婚恋关系习惯法的内容一一对应。这些内容严格制约着男女交往的行为模式,保障了侗族社会婚姻关系的秩序与稳定。《关雎》与《侗款》之间的遥相呼应,是各民族文化同源的活见证,也是铸牢中华民族共同体意识的重要基础。Guanjuis always defined as a love song, but the regulative implications in it about courtship and marriage subtly coincide withDongkuanof the Dong ethnic group.By interpretingGuanjuwithDongkuan, we may find thatGuanjuis actually a poetic style law to regulate male-female relationship. As a matter of fact, in the pre-Qin period, the Classic of Poetryhad the regulative function of customary law in terms of penalty application, marriage and family, diplomacy and politics, and market management. Lines inGuanjuactually reflect some aspects of male-female relationship. For instance, “a good young man is wooing a fair maiden he loves” refers to “what should be regulated” in malefemale relationship;“water flows left and right, of cress long here, short there,” “now gather left and right, cress long or short and tender,” and “feast friends at left and right,on cress cooked till tender” refer to “how to regulate” male-female relationship;and “play music bright,” and “bells and drums, delight” refer to “what is the normal thing to do” in male-female relationship. And these aspects correspond with some clauses of Dong ethnic customary law on courtship and marriage inDongkuan. They strictly regulate the behavior mode of male-female courtship and marriage, and safeguard the order and stability of marital relationship in Dong society. The fact thatGuanjucorresponds with Dongkuanis the vivid evidence that all ethnic groups in China originate from homological culture, as well as part of the supportive power to foster a strong sense of community for the Chinese nation.
