摘 要:当前我国环境污染纠纷与日俱增,而在解纷机制中一般最先介入的是人民调解。人民调解具有理念先进、程序灵活、解纷高效、成本低等优势。由于传统的人民调解一般适用于人数较少、范围小、因果关系明确的纠纷,而环境污染纠纷具有跨域性、侵害认定复杂性、主体多元性等导致人民调解适用的困难。因此,在完善过程中,要以新时代“枫桥经验”为引领,不断地推进人民调解,树立生态优先的理念、建立跨行政区域的环境污染纠纷人民调解组织、加强专业队伍的建设、完善人民调解与诉讼的衔接等,为优化人民调解制度提供建议。At present,my country’s environmental pollution disputes are increasing day by day,and people’s mediation is generally the first to intervene in the dispute settlement mechanism.People’s mediation has the advantages of advanced concepts,flexible procedures,efficient dispute resolution,and low cost.Because traditional people’s mediation is generally applicable to disputes with a small number of people,a small scope,and a clear causal relationship,environmental pollution disputes are cross-regional,complicated to identify infringements,and multiple subjects,which lead to difficulties in the application of people’s mediation.Therefore,in the process of improvement,it is necessary to continue to promote people’s mediation,establish the concept of ecological priority,establish a people’s mediation organization for environmental pollution disputes across administrative regions,and strengthen the construction of professional teams,Improve the connection between people’s mediation and litigation,etc.,and provide suggestions for optimizing the people’s mediation system.
