法官人身意外伤害保险制度的理性思辨与制度构建

摘　　要：构建符合司法职业特点的法官人身意外伤害保险制度是完善法官职业安全保障的重要举措,也是推进我国司法体制改革的现实要求。目前我国尚未构建法官人身意外伤害保险制度,仅有部分法院主动为本院干警购买人身保险。在借鉴域外经验与公安民警行业人身意外伤害保险制度的基础上,建议在《法官法》中新增法院为法官设立人身意外伤害保险的规定,并在参与主体、保险费、赔付事由与金额,以及承保时间方面,配合现有的保险制度有针对性地探求法官人身意外伤害保险的构建路径。同时以损害填补原则平衡法官人身意外伤害保险与工伤保险之间的适用。It is an important measure to improve the occupational security of judges to build a personal accident insurance system for judges in line with the characteristics of the judicial profession,and it is also a realistic requirement to promote the reform of the judicial system in China.At present,China has not yet built a personal accident insurance system for judges,and only some courts have taken the initiative to purchase personal insurance for judicial police officers.On the basis of drawing on foreign experience and the personal accident insurance system of the public security police industry,it is suggested to add a new provision for courts to establish personal accident insurance for judges in the Judge Law,and in terms of participants,insurance premiums,causes and amounts of compensation,and underwriting time,it is suggested to explore the construction path of personal accident insurance of judges in accordance with the existing insurance system in a targeted way.At the same time,the principle of damage compensation is used to balance the application of personal accident insurance of judges and employment injury insurance.
