摘 要:人工智能对海量实例样本进行机器学习之后创造的技术方案即人工智能生成物,其中的一部分虽然能够符合专利授予的条件,但受到专利法的立法目的、权责统一原则和当下人工智能发展情况的限制,该专利权不能被人工智能享有。同时,若将该专利授予与人工智能生成物有关的其他主体也缺乏在法律上的正当性。故建议采用代理制度、孳息制度和二者并行的方式,突破当下人工智能生成物的专利权属困境,以鼓励发明创造,提高创新能力,促进科学技术进步和经济社会发展。Although some of the technical solutions created by artificial intelligence after machine learning from a large number of instance samples can meet the conditions of patent grant,due to the legislative purpose of patent law,the principle of unified rights and responsibilities and the current development of artificial intelligence,the patent right cannot be enjoyed by artificial intelligence.At the same time,if the patent is granted to other subjects related to artificial intelligence products,it is also lack of legal legitimacy.Therefore,it is suggested that the agent system and the fruits system should be adopted to break through the patent right dilemma of artificial intelligence products,so as to encourage invention and creation,improve innovation ability,and promote scientific and technological progress and economic and social development.
