摘　　要：随着北京首开龙湖天璞自住房与商品房的拆墙之争的持续发酵,各地配建小区存在的不公与矛盾逐渐呈现在公众眼前。在各地大力推进保障房建设的大环境下,小区隔离墙拆与立之争尤为突出,并逐渐白热化,暴露出土地竞配建政策的遗留问题。这一问题不仅牵系着保障房业主、商品房业主和开发商等多方的利益,也是政府推动城市社区建设与治理需要面对的一道难题。要消除冲突以实现真正的融合共享,打造和谐的混合居住社区,应以拆除隔离墙为原则,以允许和保留合理隔离设施为例外。政府、企业、社会组织和居民要加强社会责任意识,承担起共建和谐小区的责任。同时,积极探索新的土地政策,进一步完善共有产权房制度,从根源上避免隔离墙的出现。With the continuous expansion of the first wall of Longhu Tianpu in Beijing,the unfairness and contradiction between the housing and commercial housing has gradually appeared in front of the public.Under the great environment of vigorously promoting the construction of affordable housing in various places,the dispute between the demolition and separation of residential segregation walls is particularly prominent,and it is gradually heating up,exposing the remaining problems of the land competition and construction policy.This problem is not only related to the interests of housing owners,commercial housing owners and developers,but also a difficult problem for the government to promote urban community construction and governance.In order to eliminate conflicts for true integration and sharing,and to create a harmonious mixed-living community,the principle of dismantling the wall should be adopted,with the exception of allowing and retaining reasonable isolation facilities.Governments,enterprises,social organizations and residents must strengthen their sense of social responsibility and assume responsibility for building a harmonious community.At the same time,actively explore new land policies,further improve the system of shared property houses,and avoid the emergence of the wall from the root.
