摘　　要：专利权质押是指出质人为了实现担保债权,将其专利权中可以转让的、有权处置的财产权进行质押的行为。本研究以专利文献为分析对象,对中国科学院为申请人的被质押专利自身特征、申请人/发明人特征及时间概念特征进行分析,揭示中国科学院被质押专利布局态势。最后基于中国科学院被质押专利现状,提出了提升中国科学院或科研机构、高校等相关科研部门的专利权质押效率的相关建议。Patent pledge refers to the realization of secured creditor’s rights,the pledgor has the right to dispose of the property rights in the transferable patent rights pledge,when the debtor does not perform the debt,the pledgee has the right to pay the price of the property rights in the pledged patent rights in priority according to law.Based on the analysis of patent document object,this paper analyzes the characteristics of the pledged patents for which the Chinese Academy of Sciences is the applicant,the characteristics of the applicant/inventor and the characteristics of the concept of time,and reveals the layout of the pledged patents of the Chinese Academy of Sciences,taking the patent literature as the object of analysis.Finally,based on the current situation of pledged patents in the Chinese Academy of Sciences,relevant suggestions are made to improve the efficiency of patent pledges in the Chinese Academy of Sciences or related research departments such as research institutions and universities.
