摘　　要：为严厉打击欺诈贪腐等违法行为,着力优化绿色廉洁营商环境,欧洲复兴开发银行(以下简称欧复行)对违反本行所示禁止行为的所有项目参与者制定了一整套较为完备的制裁政策及实施措施,并在一定情况下可与世界银行、亚洲开发银行、非洲开发银行、泛美开发银行等其他四家国际多边开发金融机构对被制裁对象联合发起交叉制裁。近年来,随着我国参与欧复行项目的企业逐年增多,各类风险敞口也日益凸显。鉴于目前国内对欧复行制裁的相关研究几乎是一片“蓝海”,在此特就该行最新制裁相关内容予以详细的介绍与分析,并根据既往案例及欧复行制裁独有特点为中国企业提出了若干启发性反制建议,以期为我国企业未来精准识别并有效应对欧复行等银行制裁。In order to severely crack down on illegal acts such as fraud and corruption, and strive to optimize the green and clean business environment, European Bank for Reconstruction and Development(EBRD) has formulated a set of relatively complete enforcement policies and implementation measures for all project participants who violate the EBRD’s prohibited practices, and under certain circumstances may jointly initiate mutual enforcement against sanctioned objects with four other international multilateral development financial institutions, including World Bank Group(WGB), Asian Development Bank(ADB), African Development Bank(AfDB), and Inter-American Development Bank(IADB). In recent years, with the increasing number of enterprises participating in the projects sponsored by EBRD, various risk exposures have become increasingly prominent. In view of the fact that current domestic research on enforcement policy and procedures related to EBRD is almost a “Blue Ocean”, this paper gives a detailed introduction and analysis of the latest relevant contents of EBRD’s enforcement policy and procedures, and then puts forward some enlightening countermeasures for Chinese enterprises on the basis of analyzing previous cases and unique characteristics of EBRD’s enforcement policy and procedures, with a view to accurately identifying and effectively dealing with enforcement policy under EBRD and even mutual enforcement against the world’s five major Multilateral Development Banks in the future.
