从司法审查视角看新修订的《行政处罚法》对海关行政处罚执法行为的影响

摘　　要：2021年7月15日,修订后的《行政处罚法》正式实施。新修订的《行政处罚法》明确和增设了一些更为科学合理的新规则。这势必对海关执法行为尤其是行政处罚行为产生深远影响,亟待引起海关执法部门重视,并及时调整适应。通过从司法审查视野出发,初步分析了目前海关行政处罚执法行为与新修订的《行政处罚法》要求不相适应的五大类基础性难题,并从改善行政执法和立法层面提出了相应的解决路径。On July 15,2021,the revised Administrative Punishment Law was formally implemented.Having clarified and added some more scientific and reasonable new rules,it is bound to have a profound impact on the customs law enforcement,especially the administrative punishment,to which Customs authorities should attach importance and adapt themselves.From the perspective of judicial review,this paper analyzes the five basic problems of incompatibility between the current customs administrative punishment enforcement behavior and the requirements of the newly revised administrative punishment law,and puts forward corresponding solutions in respect of improving administrative enforcement and legislation.
