《欧盟海关法典》的自由区规制及对中国自由贸易港的启示

摘　　要：自由港的雏形可追溯于欧洲的自由区,经过百年的淬炼,其法律精髓在《欧盟海关法典》之中得以渗透。时过境迁,虽然欧洲的某些自由港呈现消失的态势,但法典所设置的关于自由区的专门规制,包括自由区定位、建筑物及相关活动规制、货运单据的递交及处置程序、自由区内的欧盟货物及非欧盟货物的海关地位、货物运出自由区、货物的海关状态等方面条款,对于中国建设自由贸易港的探索仍具重要的借鉴意义。The embryonic form of free port can be traced back to the Free Zone in Europe.After long-term hardening,its legal essence has been gathered in the Union Customs Code.As time goes by,although some free ports in Europe are disappearing,the special regulations on free zones set by the Union Customs Code including the designation of free zones,buildings and activities in free zones,presentation of goods and their placing under a procedure,customs status of Union goods and nonUnion cargo in free zones,taking goods out of a free zone and customs status are still of great significance to the exploration of the construction of free trade port in China.
