教育捐赠冠名的法律风险及其防范

摘　　要：教育捐赠冠名是筹资办学的重要方式,在运作实践中应当以法治思维和法治方式防范和化解相关法律风险,包括违反地名和教育管理规范的风险、捐赠财产用途偏离慈善目的的风险、冠名商标自我淡化或混淆的风险、捐赠冠名法律关系不明的风险、违法冠名或冠名污名化的风险等。建议教育机构制备教育捐赠冠名管理办法,努力实现教育捐赠冠名的法治化运作。The naming of educational donations is an important way to raise funds for educational institutions.The thinking and methods of the rule of law should be used in the practice to prevent and resolve relevant legal risks,including the risk of violating geographical names and educational management norms,the risk of the use of donated property deviating from charitable purposes,the risk of self-dilution or confusion of the naming trademark,the risk of unclear legal relationship of donation naming,and the risk of illegal naming or naming stigma,etc.It is suggested that educational institutions prepare educational donation naming management measures,and strive to realize the legalized operation of educational donation naming.
