摘 要:调查权的缺位动摇了公证证明的公信力。一方面,调查与核实间的界限模糊,实务中不乏公证员以核实之权行调查之实;另一方面,公证的证据审查进度举步维艰。比照公证制度发达的国家,不乏公证调查权的适用规定。公权力身份是权力适用之前提,公证案件的真实性保障是公证调查适用的逻辑要求。比较研究公证的公权性质,当确立当事人申请的调查公证启动程序,细化被调查人的配合义务及拒不配合的法律后果;参照我国诉讼法制度,并重建立健全相应的司法监督机制。The absence of investigative power has shaken the credibility of notarization.On the one hand,the boundary between investigation and verification is blurred.In practice,there are many notaries who use the power of verification to conduct investigations;on the other hand,the progress of notarized evidence review is difficult.Compared with countries with developed notarization systems,there is no shortage of regulations governing the application of notarization investigation powers.The status of public power is mentioned before the application of power,and the authenticity of notarization cases is the logical requirement for notarization investigation.To compare and study the nature of public power of notarization,when establishing the procedures for the initiation of investigation and notarization applied by the parties,refine the cooperating obligations of the person under investigation,and establish a sound judicial supervision mechanism.
