“不完全劳动关系”司法审查标准的厘清与构建——以能动司法的复合性功能为视角

摘　　要：司法审查标准是关系到认定新就业形态劳动关系的重要内容。当前我国不完全劳动关系的审查标准较为模糊,审判实践中呈现概括式审查、臆断式审查、机械式审查、简易式审查。对不完全劳动关系的司法审查,应当遵循事实优先、防止泛化以及并重保护原则,根据用工事实和劳动管理程度进行认定。从能动司法的复合性功能上审视,应建立以“不完全从属性”为核心要素,具有能动的、内容丰富的、复合性的审查标准。在具体构建路径上,应重点细化人格从属性标准、丰富经济从属性内涵、淡化组织从属性概念、借助技术从属性特征,进一步明确不完全劳动关系的审查标准。同时,要坚持实质审查并合理怀疑,揭示“形式主义假面”下隐蔽的劳动关系,避免陷入外观主义审查的陷阱。Judicial review standards are important elements related to the identification of labor relations in new employment forms.At present,the review standards for incomplete labor relations in China are relatively vague,and the trial practice is either summarized review,or speculative review,or mechanical review,or simple review.For the judicial review of incomplete labor relations,the principles of fact-first,prevention of generalization,and equal protection should be followed,and the identification should be based on the facts of employment and the degree of labor management.From the perspective of the composite functions of active justice,a review standard with“incomplete subordination”as the core element,which is active,rich in content,and composite,should be established.In terms of specific construction path,it is important to refine the standard of personality subordination,enrich the connotation of economic subordination,weaken the concept of organizational subordination,and further clarify the review standards for incomplete labor relations with the help of technological subordination characteristics.At the same time,we should adhere to substantive review and reasonable doubt,reveal the hidden labor relations under the“formalistic mask”,and avoid falling into the trap of appearance-based review.
