网络安全紧急状态制度的建构意义与规制内容研究

摘　　要：构建网络安全紧急状态制度是信息时代法治国家维护网络安全的重要内容。网络安全紧急状态制度是维护网络主权、网络安全和国家安全的重要法律制度,是网络空间安全保障体系和国家安全法律制度的组成部分,具有为处置网络安全风险提供法制保障,规制网络紧急权,保护网络权利的重要功能。网络安全紧急状态制度呈现出三个重要特征:作用效果上的风险预防性、紧急措施内容的技术性和网络紧急权行使的协作性。以网络技术规范和标准界定的特别重大网络安全风险是启动网络安全紧急状态制度的风险要件;断网或切断流量、颁布和执行响应计划是行政机关行使网络紧急权采取的主要紧急措施。Constructing system of cybersecurity states of emergency is an important task for a country ruled by law to maintain network security in the information age.System of cybersecurity states of emergency is an important legal system to maintain network sovereignty,network security and national security.It is an integral part of cyberspace security guarantee system and national security legal system.It has the important function of providing legal guarantee for dealing with network security risks,regulating network emergency power and protecting network rights.The characteristics of system of cybersecurity states of emergency are“three characteristics”,that is,the preventive effect,the technical content of emergency measures and the cooperation in the exercise of emergency power.The“three characteristics”determine that the particularly significant network security risk is an important element to start system of cybersecurity states of emergency;The main emergency measures taken by administrative organs to exercise their network emergency power are to cut off the network or traffic,issue and implement the response plan.
