摘　　要：对监察规范性文件进行备案审查是“备案审查全覆盖”要求下的应然之意,但监察规范性文件所内蕴的规范品格会影响其备案审查的体系建构。其政治、法律二元属性的实体交互性,会混淆纳入备案审查的监察规范性文件与未纳入备案审查的监察规范性文件、党内规范性文件等有所关联规范性文件的界限;其内蕴政治属性的勾连性,会在审查标准上造成“对接”的混同;其所根植的“党政合署”效用场景化,会扩大党纪国法衔接的操作性难题。需要回溯国家监察制度的制度逻辑,通过前端识别和后端衔接的完善,有效消弭监察规范性文件纳入备案审查的制度张力。The filing and review of supervisory normative documents is the natural intention under the requirement of“full coverage of filing and review”,but the normative character of supervisory normative documents will affect the construction of their filing and review system.The interaction between the political and legal attributes of the entity will confuse the boundary between the supervisory normative documents included in the record review and the supervisory normative documents not included in the record review,party normative documents and other related normative documents;the collusion of its embedded political attributes will cause“docking”confusion in the review criteria;its roots in the“party and government”utility scenario will expand the operational difficulties of the interface between party discipline and state law.It is necessary to retrace the institutional logic of the state monitoring system,and effectively eliminate the institutional tension of the inclusion of monitoring normative documents in the filing review through the improvement of front-end identification and back-end articulation.
