乡村振兴视域下政府提供公共法律服务的现代化治理路径

摘　　要：公共法律服务具有公共产品和竞争品双重性质,政府将直接提供和购买公共法律服务相结合,具有保障公共法律服务供给、培育和维护乡村公共法律服务市场等多重现代化治理责任。上述责任的履行存在公共法律服务提供不足、政府过度干预、政企合谋等风险。应当坚持“以人民为中心”的发展思想,发展“全过程人民民主”,引入“竞争中立原则”为政府提供公共法律服务提供价值引领,增强正当性与可问责性,形成具体的方法论指导。在具体法律制度方面建立政府提供公共法律服务全过程评估机制、贯彻公平竞争审查制度以及确立乡村公共法律服务市场完善后政府退出机制。Public legal services have the dual nature of public goods and competitive goods.The combination of government’s direct provision and purchase of public legal services has multiple modern governance responsibilities such as ensuring the supply of public legal services,cultivating and maintaining the rural public legal service market.The implementation of the above responsibilities involves risks such as insufficient provision of public legal services,excessive government intervention,and collusion between government and enterprises.We should adhere to the development thought of“taking the people as the center”,develop“people’s democracy in the whole process”,introduce the“competition neutrality principle”to provide value guidance for the government to provide public legal services,enhance legitimacy and accountability,and form specific methodological guidance.In terms of specific legal systems,we should establish an evaluation mechanism for the whole process of government providing public legal services,implement the fair competition review system,and establish a government exit mechanism after the improvement of the rural public legal service market.
