摘　　要：人工智能技术对社会治理具有赋能作用,能够促进多元主体有效参与、提升公共政策的精准度、全方位升级政府治理系统,提升治理效能。同时,人工智能技术的应用也存在诸多风险,包括人工智能应用带来的新型社会纠纷、赋能政府治理进程中存在较高的不确定性、技术不完善造成社会公害等。防治人工智能风险,在防治策略上要坚持法律规制与保障并重,在出台规制措施时必须考虑人工智能技术创新发展的要求;在防治手段上,要做到软法与硬法同向发力,既要发挥软法的价值引领作用,更要发挥硬法的刚性约束作用;在防治方式上,要强化权力治理与技术治理协同。Artificial intelligence technology has an empowering role in social governance,and can promote the effective participation of multiple subjects,improve the accuracy of public policies,upgrade the government governance system in an all-round way,and improve governance efficiency.At the same time,the application of artificial intelligence technology also has many risks,including new social disputes brought about by artificial intelligence applications,high uncertainty in the process of enabling government governance,and social public hazards caused by imperfect technology.In view of the strategic position of AI technology,three points should be noted in the prevention and control of AI risks.In terms of prevention and control strategy,legal regulation and protection should be given equal importance,and the requirements of the development of AI technological innovation must be taken into account when introducing regulatory measures.In terms of prevention and control means,soft law and hard law should work in the same direction,meaning that both the value guidance of soft law and the rigid restraint of hard law should be brought into play.In terms of prevention and control methods,it is necessary to strengthen the synergy between the legal governance of power and technological governance,so that the two complement each other and guarantee each other.
