摘　　要：互联网用户协议是约定互联网平台与网络用户权利义务的重要协议,用户协议中的用户数据授权条款约定了网络用户对其发布、上传至平台的数据的处分权利。互联网平台的用户数据授权条款形式各异、类型不一,部分互联网平台存在滥用格式条款损害用户权益的情形。授权条款中的“所有权转移模式”“独家授权模式”及“无限授权模式”均导致用户数据在不同程度上脱离数据权利人的控制,且不具备正当、合理性,用户有权撤销、否定该类条款的效力或主张该条款不成为合同内容。为保证数据产业健康发展,我国制定统一的、规范的用户数据授权条款具有现实必要性。用户数据授权条款的设置应以平台、用户二者利益关系的平衡为出发点,遵循公平合理原则、数据安全原则、有限使用原则、知情同意原则及限制垄断原则,以合理、规范的形式予以表现。User agreement is an important agreement which provides the rights and obligations of Internet platform and network users.The users’data authorization terms in user agreement provides the right to dispose of the data published and uploaded to the network platform by network users.The users’data authorization terms of domestic and foreign network platforms are different in form and type,and some network platforms abuse format clauses to damage users’rights and interests.The“ownership transfer mode”,“exclusive authorization mode”and“unlimited authorization mode”in the terms of authorization all result in the user data being out of the control of the data right holder in varying degrees,which is not justified and reasonable,The users have the right to deny the validity of such terms.In order to ensure the healthy development of data industry,it is necessary to formulate unified and standardized user data authorization terms in China.The establishment of users’data authorization terms should be based on the balance of interests of network platform and users,and follow the principle of fairness and reasonableness,principle of data security,principle of limited use,principle of informed consent,and expressed in reasonable and standard form.
