摘　　要：先“物”后“权”、“物”量度“权”是物权的结构性特征,决定了“物”与“权”协同联动之物权变动理论才可能是符合法理的。物权之“物”以及该物的拟受领人及其该物权的拟取得人是债权行为指向的对象,而物权行为理论仅关涉物权之“权”的变动。受领/登记是对债务人物权行为之效果意思的确定,法律据此确定物权发生变动。物权形式主义与意思主义之物权变动并存的根本原因似乎是,立法对物权行为之效果意思确定方式之不同选择:物权形式主义以受领或登记为准,意思主义则以合同生效时间为准。由此形成了生效主义与对抗主义之物权变动公示效力。债权合同被宣告无效或者被撤销,意味着受领/登记在法律上不复存在,无法维系给付人物权行为之效果意思,物权行为消灭,物权不生变动,物权行为之无因性不能成立。Due to the structural characteristics of real property right of“Right”to protect“Res”and judged by“Res”,the theory of real right conveyance that can be theoretically logical is the one with the coordinated linkage of“Right”and“Res”.“Res”and the potential recipient of both“Res”and“Right”,is the object of Creditor’s rights.The juristic act of real right only concerns the change of“Right”,with the delivery or registration as the confirmation of the effective intention of the debtor.The reason for the coexistence of formalism and intentionalism for real right conveyance,is the different options of legislators for the form of confirmation of the effective intention:real right formalism requires the delivery or registration,while intentionalism refers to the taking effect of contract.This different options lead to the potency division of registration confrontation and consensual effect.The delivery or registration cannot legally exist if the relevant contract is declared avoid or revoked,therefor the effective intention of the juristal act of real right is unsustainable and could not result in real right conveyance,in this sense,the so-called non-causation principle of juristic act of real right is untenable.
