摘　　要：醉驾入刑10年来,社会影响与日俱增,对抑制严重醉驾行为、保护人民生命财产发挥了重要作用。实证数据显示,因醉驾入罪门槛低、出罪机制不完善、前科封存制度阙如、刑罚严厉性不足等,导致当前我国醉驾治理面临着打击面过宽和对潜在违法者威慑力不足的双重困境。破解双重困境的总体思路,在于健全宽严相济的醉驾治理体系。具体而言,在刑事立法上,适当提高醉驾入罪门槛,加大刑罚规制力度,确立轻罪前科封存制度;在刑事司法上,建立醉驾案件暂缓起诉制度,规范缓刑适用;在刑事执行上,建立“易科罚金刑”制度,完善检察监督;在行政执法上,加大严格执法力度。在此基础上,形成危险驾驶罪与交通肇事罪相互衔接、公检法工作相互协调、公安司法与发案单位及纪检监察机关间协作配合的多元化、多层次的立体型醉驾治理机制,最终实现醉驾行为的有效治理,助推我国治理体系和治理能力现代化进程。Since drunk driving was criminalized by legislation.it has played an important role in protecting people’s lives and property for ten years.Empirical data show that low threshold for criminalization of drunk driving,the inadequate criminal record systemas well as the inadequate severity of penalties result in the dual dilemma of overly wide range of attacks and insufficient deterrence against potential offenders.The key to the dilemma is to improve the drunk driving governance system with both leniency and strictness.Specifically,the law enforcement agencies should appropriately raise the threshold for criminalization of drunk driving,strengthen penal regulations and establish a minor criminal record sealed system in criminal legislation,establish deferred prosecution system for drunk driving cases,strictly regulate the application of probation in criminal justice,establish Converting Imprisonment into Fine system and strengthen the supervision of procuratorial organs in terms of criminal execution,intensify strict law enforcement in administrative law enforcement.And then,a diversified and multi-level drunk driving governance mechanism will be formed that connects the crime of dangerous driving and the crime of traffic accidents,strengthening the cooperation between the judicial organs and the discipline inspection organs.Finally realizing the effective management of drunk driving,and promoting the modernization of my country’s governance system and governance capabilities.
