“犯罪互动中心论”:犯罪学面相与刑法学启示  

“The Theory of Interaction Center of Crime”:The Face of Criminology and the Enlightenment of Criminal Law

摘　　要：在体现对“罪行中心论”和“罪人中心论”的“兼容性”的同时,又通过“关系性”、“立体性”、“构造性”和“系统性”征表其理论特质,进而通过“疏导型犯罪治理策略”来隐现其策略导向,这些刻画了“犯罪互动中心论”的犯罪学面相。立于犯罪学犯罪本体即犯罪关系,“犯罪互动中心论”不仅给刑法学以犯罪本体论、刑罚本体论和罪刑关系本体论的重要启发,而且通过“犯罪定义权”给予刑法学以权利刑法观、共识刑法观、公信刑法观、理性交往刑法观和融合范式刑法观的重要启示。“犯罪互动中心论”对刑法学的重要启示既有刑法本体论方面的,也有刑法价值论方面的,还有刑法学方法论方面的。“犯罪互动中心论”给予刑法学的重要启示生动有力地说明:犯罪学具有作为刑法学的“基础学”和“母体学”的重要地位,因此刑法学与犯罪学的“方法交叉”,甚至是“理论融汇”,不仅是必要的,而且是可行的。进一步来说,“刑事学一体化”不仅是必要的,而且是可行的。At the same time of showing“compatibility”of“theory of crime center”and“theory of offender center”,with“relationship”,“stereospecificity”,“constructivity”and“systematicness”to indicate its theoretical characteristics,further expressing its strategic leading by“convective crime-governing strategies”,and those portrait the face of criminology of the“theory of interaction center of crime”.Based on that crime ontology is criminal relation in criminology,“theory of interaction center of crime”not only gives out important enlightenment of criminal law crime ontology,punishment ontology and ontology of crime-punishment relationship,but also gives out important enlightenment of right concept of criminal law,consensus concept of criminal law,credibility concept of criminal law,communicative reason concept of criminal law and converged paradigm concept of criminal law by“power of definition of crime”.The important enlightenments to criminal law by“theory of interaction center of crime”in not only on aspect of criminal law ontology,but also on aspects of criminal law axiology and methodology.The important enlightenments by“theory of interaction center of crime”deeply show:criminology has important position as“foundation”and“matrix”to criminal law,thus“cross-referencing methodologies”even“theoretical fusion”is both necessary and possible.Further more,the“integrated criminal science”is both necessary and possible.
