摘　　要：统筹陆海自然生态保护,既需要从全局出发,将海洋生态保护纳入自然生态保护的总体制度框架体系,对陆海自然生态实施整体性统一保护,也需要重视海洋自然生态的特殊性。我国目前有关海洋生态保护的法律规定存在诸多不足,无法满足统筹保护陆海自然生态的需要,这在一定程度上增强了我国自然生态保护法体系化与法典化的必要性。“自然生态保护法编”作为我国环境法典中的一编,在构建我国自然生态保护整体性制度框架体系,将海洋自然生态纳入其保护范围的基础上,在第五章“生态要素利用管控与保护改善”中设专节保护海域和海岛两种特殊的海洋生态要素,而且有必要在第六章“生态区域保护”中设专节保护海岸带和区域海两种特殊的海洋生态区域。To coordinate the protection of land and sea natural ecology,it not only needs to start from the overall situation to integrate the protection of marine ecology into the overall institutional framework system for implementing the integrated and unified protection of land and sea natural ecology,but also needs to pay attention to the particularities of marine ecology.There are now many deficiencies in the relevant laws and regulations of marine protection in China,which cannot meet the needs for overall protection of land and sea natural ecology.This reality strengthens the necessity of systematization and codification of the natural ecological protection law.As a part of Environmental Code,the Natural Ecology Protection Law sets up the overall institutional framework,which includes marine natural ecology in its protection scope.On this basis,Chapter 5 Ecological Elements Utilization Control and Protection Improvement should set up a special section to protect two special marine ecological factors,i.e.sea area and island.Besides,it is necessary to set up a special section in Chapter 6 Ecological Area Protection to protect coastal zone and regional sea,two special marine ecological areas.
