摘　　要：民国比较法研究对当时的立法有着直接的现实影响。民国时期多部法律在起草过程中,都经历了介绍各国法律内容、举例西方立法技术、探讨法律与国情的结合,进而对草案的各项议题进行讨论等环节步骤。本文将选取最为重要的宪法、刑事法律和民事法律为分析范本,考察民国时期法典编纂与比较法研究的关系。The study of comparative law in the Republic of China had direct practical influence on the legislation at that time.During the drafting process of many laws in the Republic of China,they introduced the legal contents of various countries,referred to western legislative techniques,combined laws with national conditions,and then discussed various topics of the draft.This article will choose the most important constitution,criminal law and civil law as an analysis model to investigate the relationship between codification and comparative law research in the Republic of China period.
