摘　　要：现实社会,由于信息不对称及垄断的大量存在,传统的意思自治原则已经难以有效地解决当代经济领域中的矛盾,市场在意思自治原则的指导下逐渐失灵。因而,在合同法领域,应从意思自治原则过渡到公平交易、信息对称原则,在法律条文中贯彻平衡信息、鼓励消费,减少成本思想,规定公用事业单位强制缔约义务,并通过法官的积极干预,有效实现公平与效率。Because of the monopoly and information dissymmetry, the traditional principle of self-rule idea has difficulty in resolving the contradiction in modern economic field. And the market becomes malfunction under this traditional principle. So in the contract field, the self-rule idea principle should transit to fair deal and information symmetry principle.
