关于打击“两非”的法理思考

摘　　要：父母对胎儿的知情权应该包括胎儿的性别,但是,为了社会公共利益的需要,可以对其进行限制。政府打击“两非”的活动要依法进行,不能违法执法。现行刑法对打击“两非”不能提供完全法律支持,对已取得医生职业资格的人的“两非”行为的打击无法可依,立法的疏漏应该及时调整完善。Parents' rights to know truth include the right to know the fetus sex,which is nevertheless to be restricted according to public rights.The government's two vigorous combats must be carried out according to the law.But the present criminal law can not somewhat meet the ends,which can be shown in the case that people who have got a doctor certificate can not be combated legally,for there is no relative law.So the adjustment of the law is needed timely.
