儿媳在公婆遗产继承中法律地位的再思考

摘　　要：如何协调好儿媳与公婆的关系,关系着许多家庭的和谐。婆媳关系涉及很多方面。从继承当中的婆媳关系看,依据《继承法》权利义务相一致原则和养老育幼原则,并辅之于民法之公序良俗原则,目前儿媳在公婆遗产继承中的法律地位及其法律效果还不尽如人意。应在坚持权利和义务相一致原则的同时,以有利养老为目标价值提出相应的立法建议。The harmony of a family depends to large extent on how the relationship between the mother and daughter in-laws is,which covers many aspects.In regard to inheritance,the current legal status and effects of daughter-in-law's inheritance of the legacy of mother-in-law is not satisfactory,according to the principle of the consistency of rights and obligation,the principle of the nurturing of the old and the young,the principle of Public Order and Good Social Customs in civil laws.We shall put forth legislative proposals on the basis of the principle of rights-obligations consistency and the objective to benefit the care of the senior citizens.
