摘　　要：随着网络和计算机技术的发展,美国以及一些西方国家纷纷对商业方法软件授予了专利权。商业方法软件的专利保护打破了传统的“商业方法除外”原则,对软件保护模式产生了重要影响,对其产生的原因和影响应进行多方面分析,并据此提出完善我国计算机软件保护模式的建议。As the network and computer technology develops, United States and othe r western countries have granted patented rights to business method software. Th e patent protection of business method software, having broken through the tradi tional business method exception principle, will impose great influences on the software protection mode. An all-around analysis of the causes and effects of bu siness method protection is needed so as to generate some advice on how to impro ve the protection mode of China's computer software.
