摘　　要：信息经济时代个人数据具有重要的经济价值与社会价值,许多国家制定个人数据保护法以促进个人数据的有序流动。国外的个人数据保护法存在着个人数据定义、敏感数据的利益分享、跨国流动国际协调机制以及执行效率等问题。我国个人信息保护立法应明确个人数据的法律内涵、尊重个人数据人格权与利益分享前提、设立独立的保护机构与明示拒绝机制,以及鼓励企业试行有约束力的企业规则。Personal data has very important value of economy and society.To boost ordering flow of personal data,many countries have enacted law for the purpose.The actual personal data protection laws have many problems such as the definition of personal data,interest share of sensitive personal data and so on.Legislation of personal data in China must define the concept of personal data,respect the personality power and interest participation,set up the protection institution and opt-out system,encourage the Binding...
