摘　　要：在分析中国传统法律时,应基于整体性法学观,正确认识德、礼、法三者的关系,把握中国传统法律之伦理本质。中国传统法律伦理化,是中国特定历史条件的产物,促进了古代中国的国家统一与政治稳定,但因与现代政治所追求的正义、权利、自由、自治、民主、平等、宽容等价值格格不入,客观上阻碍了中国的政治发展。When Chinese traditional law is analyzed,special attention should be paid to correctly understanding the relation among morality,ritual and law,and to rightly holding its essence characterized by the dominance of ethics in accordance with an integrative jurisprudence perspective.Chinese traditional law dominated by morality and ritual was the outcome of the particular historical states in ancient China,which promoted the unification of the whole nation and political stability on the one hand,hindered the po...
