摘　　要：代位权制度是债的保全制度之一,在我国最初规定于新合同法中,对解决三角债问题,保护债权人利益发挥着不可替代的作用。代位权的构成要件堪称此制度的核心之一,本文欲以合同法中关于代位权构成要件为基础,对其展开新的研究与探讨。The system of credior's subrogation is one of the debt preserves system.In our country it is stipulated in the new contract law at first to solve the triangle debt problems and protect the creditor benefit.It is playing the role which cannot be substituted.The constitution of generation of position power is important,it may be called one of this system cores,this article wants to research and discuss this problem with some new ideas.
