摘　　要：房屋二重买卖是现实生活中颇为常见的现象 ,在房地产价格不断上涨的情况下尤为如此。由此也产生了一系列相关问题 ,如合同效力的认定 ,受害人权利的法律救济等 ,这些都是在理论界与实务中有较大分歧的问题。Dual sales of a house are quite common in daily life, especially when the price of real estate keeps rising. It brings about a series of relevant issues such as : validity identification of the sales-contract and legal relief of the victim's rights. It presents conflicting ideas in a theoretical as well as practical fie ld. In this article, the author has a detailed analysis of the above issues.
