略论情事变更原则

摘　　要：情事变更原则是现代民商法的重要原则之一,我国立法至今未予明确规定是一大缺憾。现代社会,国际、国内经济、政治形势不断变化,导致合同当事人之间的利益严重失衡,需要运用情事变更这一法律原则维护合同正义和交易秩序稳定。本文分析了情事变更原则与不可抗力的联系与区别,阐明了情事变更原则的构成要件和适用效力,并进一步提出我国立法应尽快完善情事变更原则。Principle of affairs alteration is one of the important principle of m odern civil and commercial law and it is a great regret that Chinese law has no express regulation about it. In modern society, constant changes of economic and political situation at home and abroad lead to serious unbalance of benefit bet ween parties and it is necessary to use the principle of affairs alteration to m aintain the justice of contract and stability of transaction order. This text an alyses the contacts and differences between the principle of affairs alteration and power not resisted, expounds the components and effect of application and re commends further that Chinese law should perfect the principle of affairs altera tion as soon as possible.
