摘　　要：家庭联产承包制在实践中暴露出了一些深层次的缺陷 ,这一切的关键是法律没有明确土地承包经营权的性质。事实上农村土地承包经营权是物权 。Since the implement of household responsibility system, the lawful nature of rural land managing rights has not been clear, and should be further discovered. Comparing the difference between the title theory and credit rights theory, the land managing rights should be a new use title under the household responsibility system.
